QUESTION:
We are sending you some excerpts from M Saad’s Bayaan. Please study it and give your opinion regarding it, whether these statements are in conflict or conforming to the Shariah. Furthermore, since M Saad has not accepted the Shura and the method of working that was formed by the TJ Elders at the Raiwind Ijtema, should the Tablighi Jamaats still go to him or not? Is it appropriate for Jamaats to go to that environment where he and his like-minded companions are based? Please advise.

ANSWER:
With regards to the above question, some people sent us some excerpts from some of the Bayaans of Ml Saad Sb. Darul Uloom Deoband also has some excerpts in their Fatwa. In these excerpts, there is an attack on the honour of some of the Ambiya (AS) and the Aqaaid (beliefs) of the Ahlus Sunnah Wal Jamaat. In fact, his statement regarding Moosa (AS) that “he left his people and Jamaat and went into solitude to commune with Allah Taala because of which 588000 people of the Bani Israel went astray: Moosa (AS) was the asal and he alone was responsible. The Asal should have remained with them.”
As a result of this claim, a direct objection is made to the Words of Allah Taala, because Allah Taala instructed Moosa (AS) to go to Mount Thur. Allah Taala says:
وَإِذْ وَٰعَدْنَا مُوسَىٰٓ أَرْبَعِينَ لَيْلَةًۭ ثُمَّ ٱتَّخَذْتُمُ ٱلْعِجْلَ مِنۢ بَعْدِهِۦ وَأَنتُمْ ظَـٰلِمُونَ
And ˹remember˺ when We appointed forty nights for Moses, then you worshipped the calf in his absence, acting wrongfully.
(Al Baqarah 51)
Hazrat Hakimul Ummat Maulana Thanwi (RAH) mentions in the commentary of this Ayat that Allah Taala promised Moosa (AS) that you must come to Mount Toor and spend one month devoting yourself to my Ibaadat. We shall give you a Kitaab, Moosa (AS) complied and received the Torah. (Bayaanul Qur’aan)
Thus, in complying with Allah’s command, Moosa (AS) went to Mount Toor. He did not go on his own accord.
From other excerpts, we perceive the stench of belittling and degrading other branches of Deen, and his statement “those that are taking a salary and teaching Deen are selling their Deen” is tantamount to saying that our Akaabir(Senior) Asaatizah were sellers of teen. Likewise, to claim that the conditions stipulated In Shariah for the acceptance of Tawba are incomplete without Khurooj (Striving in the path of Allah) is an addition to Deen.
As a result of these types of Bayaans and statements, a Fatwa against him was issued by Darul Uloom Deoband and endorsed by Mazahirul Uloom Saharanpur and Jamia Islamia Dhabel India. We concur with these Fataawa.
Prior to this, approximately 60 Ulama from Bangladesh have also opposed M Saad’s view and modus operandi.
As a result of such a situation, senior Ulama and Elders, the likes of Ml Ibrahim Sb, Ml Ahmed Laat Sb, Prof Sanaullah Sb and other senior personalities were compelled to leave the Markaz. On this basis, as long as Ml Saad Sb does not retract from these types of objectionable statements unconditionally and does not adopt the path of those Elders whom Allah Taala accepted for this noble work and as long as he does not follow Mashwara people should stay away from Ml Saad Sb and likewise people should stay away from that environment where all his followers are present, who agree with him thoughtlessly and readily accept whatever he propagates or proposes.

We are in agreement with the reply given above that the views and Aqaaid of Ml Sa’ad Sb are definitely contrary to the Aqaaid (beliefs) of Islam. The Ahlus Sunnat Wal Jamaat and senior ulama of Deoband are free from such beliefs and disagree with it. Therefore, whoever makes such statements, whether he is an Aalim or Shaikh, it is not permissible to sit in his company, take any benefit from him, have any affectionate relationship with him and, especially in the matters of Deen, regard him as a leader, Ameer or guide is not permissible. It is necessary to distance oneself from him.
